Privacy Policy Privacy Policy

Updated as of October 2, 2013

This privacy policy (the "Policy") explains how your personal information is collected, used and disclosed by ("YouInc.") and its operator, Arlene Dickinson Enterprises, Ltd. ("ADE", or "we", "us" or "our"). This Policy applies to the websites of YouInc. and ADE, including and any other online or mobile applications and/or services operated by ADE or under the brand YouInc. (collectively, the "Websites").

YouInc. is intended to let you meet and interact with entrepreneurs in order to share stories, experiences, advice and support. Like any website that offers a service where you register and provide information about yourself, your business or your opinions, it is wise to pay attention to your personal information. We consider "personal information" to be any information about an identifiable individual, whether public or private.

We value our members and guests and respect your concerns about online security and privacy. We believe in providing you with a safe and secure online experience. This Policy is intended to protect your privacy and ensure that your personal information is handled in a safe and responsible manner. By visiting or using a Website, you thereby accept the policies and practices described in this Policy and agree and expressly consent to our collection, use and disclosure of the information that you provide, or that is collected about you, on the terms of this Policy.

User Information Collected by YouInc.

Personally Identifiable User Information

We collect information about you in various ways when you use our Websites. For example, we collect personally identifiable information you provide to us, such as when you register on the Websites, including your user name, email address, a user-chosen password and other personal information that may be pulled through social sign-in (which is subject to the privacy controls on the applicable social media site you use). We may store and process personally identifiable information in Canada and other countries.

Cookies and Passive Data Collection

Some information is automatically collected when you visit the Websites. For example, user information and clickstream data, including IP address, access times, browser type, operating system, page views and the website you visited before our Websites is logged automatically. When users visit particular pages within the Websites, a User ID may be placed in the URL, allowing customized features for the user. Users should be aware that other websites visited before entering our Websites might place personally identifiable information within a user's URL, and we have no control over such websites. Accordingly, some personal information may be logged by a subsequent website that collects URL information. In addition to the standard log information, we may use a variety of technologies to create a more personalized experience for users. For instance, we may automatically collect information using "cookies." Cookies are small data files sent by websites to a user's browser and hard drive that identify the computer to the website. We use both session and permanent cookies to enhance user experience. We may also use cookies to enable customizable content for users, as they become available.

Internet browsers usually include the option to disable cookies and continue to access the Websites. If you choose to remove cookies or reject cookies, this could affect certain features or services on our Websites. Please note, if you use more than one type of browser, or more than one computer to access the internet, you will need to opt out in each browser and on each computer that you use.

We may also collect information using Google analytics, which use Pixel tags. Pixel tags are tiny graphic files that are included in HTML-encoded e-mail messages. We may use pixel tags to gather information about the e-mails we send to our members. When such a message is opened in an HTML-capable e-mail program, the recipient's computer accesses our server to retrieve the pixel tag file, and allows us to record and store the date and time, the recipient's e-mail address, and other standard logging information. The pixel tag also may read cookies. Websites may also contain similar pixel tags that allow us to count users who have visited those pages, and to compile aggregated statistics about site usage. Our Websites may also contain pixel tags placed there by third parties, to monitor the effectiveness of their advertising. We do not have access to, nor control over, advertisers' cookies or how they may be used.

Managing Your Privacy Settings

We believe that it is important for you to be empowered to manage the degree to which your personal information is available to the public, other registered members of YouInc. and the "followers" you have accumulated on YouInc. Accordingly, the Websites allow you to set your "Privacy Settings".

Selecting either "Anyone", "Members" or "Just Followers" will enable you to control who sees your information in each of the applicable fields. For example, by selecting "Just Followers", you will block all users, including registered members of YouInc. who are not your followers, from seeing your profile page and followers list.

Social Sign-In

YouInc. gives users the option of "social sign-in", whereby instead of logging on directly to the Websites, users log on through one of several social media sites using their account on that social media site. YouInc. supports social sign-in via Facebook, Twitter, Google+, Yahoo and Linkedin.

Social sign-in has been made available as an additional, option level of safety and security for users to protect their "Profile Information", which means your username, email address and password, and optionally certain information about your business and interests. However, social sign-in also gives us access to certain information about you, depending on your privacy settings in the social media platform that you use to sign in. For example, when a new member creates a profile by signing in through Google+ or Yahoo, we gain access to that user's name and email address from Google+ or Yahoo. If a user signs in via a Facebook account, we have access to that user's profile photo, date of birth, gender and location, unless that information has been blocked by the user in the Facebook privacy settings. Ultimately, regardless of which platform you log-in with, our access to your information is governed by the privacy policy of the relevant social media site. Those polices can be found at the following websites:

All personal information that is collected by us in connection with social sign-in is used, protected, disclosed and/or discarded pursuant to the terms of this Privacy Policy (see in particular the "How YouInc. Uses the User Information" section, below).

Document Retention Policy

All personal information collected by us in connection with your use of the Websites, including, without limitation, your name, email address, pictures, friend connections, business, messages, comments, login information, IP addresses and other data, will be stored only for as long as reasonably necessary for the purposes for which it was collected (as outlined in this Policy) or to comply with any applicable legal reporting or documentation retention requirements.

How YouInc. Uses the User Information

Personally Identifiable Information

We use personal information collected through our Websites for the purposes described throughout this Policy, disclosed to you on our Websites, or in connection with the services we provide. Subject to your Privacy Settings, personally identifiable information, including members' pictures and names, will be displayed to people, including people who are not members of the Websites, in order to facilitate user interaction on YouInc. To facilitate searching and finding friends and acquaintances on the service, the Websites allow users to search for other members by user name. We use email addresses to circulate a recurring bulletin (which you may opt out of receiving by following the instructions included with every bulletin) and may also use email addresses to send useful information to all registered users regarding the Websites, including news about contests, surveys, products and services offered by YouInc. and our selected partners.

Subject to your Privacy Settings, all visitors to the Websites, including non-members, may be able to view other users' profiles, comments, photos, videos, blog posts and friend list pages, which may include personal information. We may also link or combine with other personal information we get from third parties, to help understand your needs and provide you with better service.

Cookies and Passive Data Collection

We use cookie, IP address, clickstream, Google analytics and URL information to, among other things, improve the content of the Websites, the quality of our services, and to provide enhanced features to users, where available. We use cookies to save UserIDs, session validators, including saving on users' browsers and hard drives, and may use them to provide tailored products or services to those users, as they become available. We may also cross-match user information with information collected from cookies and clickstream data in order to test features of the Websites, and to better personalize our various offerings for users. IP Addresses also help us to diagnose problems with our server, to administer the Websites, and to otherwise provide our services to our users. IP addresses may be disclosed to a third party if we believe in good faith that the law or legal process so requires, or to protect the rights or property of ADE or others. From time to time we may extend various offers from various partner companies, sponsors or advertisers, including news or additional details on products and services. A user's usage history may result in specifically tailored special offer screens or products. We may also produce aggregate reports for advertisers. We also use such non-personally identifiable information collected through your use of the Websites to monitor website traffic, collect statistical data, and determine the effectiveness of content.

Profile Information

YouInc. allows members to provide information to a profile and other parts of the Website(s) that is accessible to other users. We use this profile information for the purposes of providing our services to you, such as to analyze demographics, to better personalize our various offerings for users, or to enable other users to find your profile. Subject to your Privacy Settings, all information, including any personally identifiable information, which is disclosed by users in his or her public profile and other parts of the site may be available for others to see on the Websites. Please do not post direct contact information in either your profile or other locations, such as your email addresses, URLs, instant messenger IDs, phone numbers, full names, or addresses. We also caution you not to share sensitive information (such as social security numbers, credit card numbers, and driver's license numbers) with other users, or place such information in your profile.

Published Information

Furthermore, when you publish content or information using the "anyone" setting, you are allowing everyone, including people not registered with YouInc., to access that information and to associate it with you. Any information disclosed using the "anyone" setting is public information that may be viewed and collected by any party. We cannot control the use of information disclosed in blogs, comments, walls or profiles under the "anyone" setting, and you should exercise caution when disclosing information, including photos and images, in such public areas of the Websites.

Childrens' Privacy

At YouInc., we know that entrepreneurialism and the entrepreneurial sprit comes in all shapes and sizes, and that inspired and innovative ideas come from thoughtful people of all ages. We are also concerned for the safety and wellbeing of our younger audience and membership. Accordingly, for any users under the age of 13, we will require verifiable, informed consent from a parent or guardian, reasonably satisfactory to us, in order for that below-13 user to use our Websites. YouInc. allows members to upload and share content and information. You own the content and information that you post on the Websites and have the ability to control how it is shared through your privacy settings. For content that is covered by intellectual property rights, including but not limited to photos, videos and written compositions (the "IP Content"), you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP Content that you post on or in connection with YouInc. or any Website (the "IP License"). For example, we may make commercial use and/or otherwise display your name and/or IP Content in or in connection with endorsements of and/or advertisements promoting YouInc., ADE, their services or related interests. This IP License ends when you delete your IP Content or your account by requesting that an administrator delete it (email here, unless your IP Content has been shared with others, and they have not deleted the IP Content. We may maintain backup copies of the IP Content, as part of our document retention policy.

Please see the Terms and Conditions for further information about the IP License.

Surveys and Contests

At various times we may offer surveys or contests to users. Surveys and contests may ask for contact, demographic or unique identifying information to increase the value of the results or to determine eligibility. We may use information collected from surveys and contests for the entertainment of users, and to determine, notify and contact winners of various contests. We will not share a user's email address with third parties unless the user specifically opts-in to such sharing during the completion of or registration for a survey or contest.

Individual contests will be governed by specific rules and regulations that will be made available in connection with the applicable contest, and should be consulted by all participants in the contest.

Third Party Links

Links to third party websites that are found on the Websites may, or may not, use cookies, pixel tags and web tags. Our Websites may provide links to third party websites, which may, or may not, use cookies, pixel tags and web tags. Ad servers may also use these tools to compile information about where users saw particular advertisements, and to determine which ads were clicked on. We are not responsible for, or have any control over, the privacy policies of those third party websites and ad servers, and encourage all users to read the privacy policies of each and every website visited when linking directly from our Websites.

Protection of YouInc., ADE and Others

We may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to regulatory disclosure orders, court orders, subpoenas or other legal process. We may also disclose information about our users to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms of Service; respond to claims that any posting or other content violates the rights of third-parties; respond to your requests for customer service; or protect the rights, property, or personal safety of YouInc., ADE, our users or the general public.

We use Secure Socket Layer (SSL) encryption to protect all data sent between our servers and a user's browser. All the traffic is encrypted using either 128 or 256 bit RSA encryption, depending on what is supported by a users browser. Your password is stored one-way encrypted, meaning that we do not have access to it. Although we make good faith efforts to store the information collected by the Websites in a secure operating environment that is not available to the public, we cannot guarantee complete security. Further, while we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from illegally obtaining this information.
