Is there a way that a franchise agreement can be broken?

Hi Kelly,

A franchise agreement is a legal and binding contract between a franchisor and franchisee. If you have a dispute with your franchisor, your first step should be to voice your concerns to your franchisor, either directly or through your franchisee advisory council (if one exists within your franchise system). If, that provides no remedy and you still wish to terminate your agreement with your franchisor, then  first recognize that you are bound by the terms of that contract. You will need to seek the advice of a competent franchise lawyer who can examine the facts of your situation in order to determine whether there are any grounds for termination of your franchise agreement or whether the remedy of rescission is available under the provisions of any relevant provincial legislation. Generally franchise agreements do not provide the unilateral right for a franchisee to terminate.
